Description of Services
JHL TRANS INC provides road freight trucking and delivery services, including full truckload carriage, less-than-truckload consolidation, regional drayage and port runs, refrigerated transport, flatbed and oversize moves, and cross-dock and storage services. We arrange the movement of freight by road across the western United States and, where agreed, to other destinations.
Our website describes the services we normally offer, but the availability of any particular service may vary depending on equipment, route, capacity, regulatory permits, and the nature of the freight involved. We will confirm exact service scope, timing and price for each shipment at the time of booking.
Eligibility
To use our services, you must be at least eighteen years old and capable of entering into a legally binding agreement. Where you book on behalf of a company or organization, you confirm that you are authorized to bind that entity to these terms.
By providing forwarding instructions, you represent that the freight is lawfully possessed of the person tendering it and that you have the authority to direct its transportation and to accept these terms on behalf of the cargo owner. You agree that you are responsible for the accuracy of all information you provide.
Quotes and Pricing
Quotes we provide are estimates based on the information you supply at the time, including weight, dimensions, distance, equipment needs and designated accessorial services. A quote does not become a binding offer until we confirm a booking and you accept it in writing.
Final charges may be adjusted to reflect accurate weights, actual routing, fuel surcharges, taxes, tolls, permits, detention, and any services required to complete the haul that were not disclosed at the time of the quote. Any such adjustments will be documented on your invoice.
Booking and Scheduling
Shipments are booked through our dispatch team by phone, email, or web form. A booking is confirmed once we agree on the date, origin, destination, equipment, and price. You must provide a complete and accurate pickup address, delivery address, contact person, and a valid telephone number for both locations.
Pickup and delivery times are commitments we work hard to meet, but road conditions, weather, equipment issues and terminal delays can affect them. We will notify you promptly of any material schedule change. Except as otherwise agreed, you allow reasonable waiting time at pickup and delivery as described under detention below.
Customer Obligations
You agree to provide accurate and complete shipment information and to ensure your freight is ready and accessible at the scheduled pickup time. You will make arrangements so that our driver can safely load or hook the trailer at the origin and unload at the destination within the allowed free time.
You will clearly communicate any special requirements, such as lift gates, pallet jacks, dock access, or oversize routing, at the time of booking so that we can assign suitable equipment. You will also designate a responsible contact who is available during the entire movement to answer questions and receive updates.
Freight Tendering and Packing
You are responsible for tendering freight in good condition and packed, marked and labeled in a manner appropriate for ordinary road transport. Freight must be securely palletized, boxed, wrapped, or otherwise stabilized so that it can be loaded and unloaded safely.
By tendering freight you represent that it has been packed reasonably to withstand normal transit. We may refuse to accept freight that is improperly packed, hazardous without declaration, or that poses a safety risk to our drivers, equipment or the public. Fragile or high-value items should be declared at booking.
Hazardous and Regulated Materials
Shipments of hazardous materials regulated by government agencies are accepted only when properly classed, packed, marked and documented in full compliance with all laws. You must disclose the hazardous nature of any freight before booking and provide the appropriate shipping papers and labels.
We reserve the right to reject, or to step down from, any shipment that is misdeclared or not offered in compliance with applicable regulations. You are solely responsible for any fines, penalties or costs arising from noncompliant, undeclared, or mislabeled hazardous materials, and you agree to indemnify us for them.
Payments and Fees
Payment terms are agreed at booking. Unless stated otherwise, invoices are due within the period shown on the invoice. We accept payment by the methods we communicate to you for each shipment. Full payment is required before a load is released where we have agreed so.
Overdue amounts may accrue interest at the highest rate permitted by law, and we may suspend further service until outstanding balances are settled. You are responsible for all applicable taxes, customs charges, duties, and government-imposed fees associated with your shipment, unless we agree in writing to arrange them.
Title, Risk and Insurance
Title to the freight remains with the owner and does not transfer to JHL TRANS INC during transport. We act as a carrier moving cargo under instructions received from the party that engaged us.
Our standard transportation coverage applies to goods in our custody subject to the exclusions and limits stated in our tariffs and these terms. We recommend that you maintain your own cargo insurance for full replacement value. If you wish to declare a higher value for carriage, you must do so in writing before pickup, and we will advise whether additional insurance or a higher limit is available.
Liability and Claims
Our liability for loss or damage to your freight is subject to applicable transportation law and the limits described in our tariff or agreed contract. Claims must be reported promptly and in writing. You must notify us within the time limits required by law after delivery, or within a reasonable period where discovery of damage occurs after delivery.
Claims for loss or damage must be supported by evidence including the original bill of lading, photographs, and a description of the items and their value. We will respond to claims within a reasonable time. Failure to meet reporting deadlines may reduce or bar a claim.
Indemnification
You agree to indemnify, defend and hold harmless JHL TRANS INC, its officers, employees, contractors and agents from and against any claims, damages, losses, liabilities, costs and expenses, including reasonable legal fees, arising out of or relating to your breach of these terms, your violation of any law, or the nature or handling of your freight.
This indemnity extends to claims made by third parties that are caused by your failure to disclose hazardous materials, by your provision of inaccurate information, or by the condition of the freight when it was tendered to us.
Accessorial and Detention Charges
Services beyond standard terminal handling, such as liftgate use, inside delivery, residential pickup, hold for pickup, and TSA or customs checks, may attract additional charges that reflect the extra time and equipment involved. These charges will be disclosed to you when they are known before transit.
If a driver is required to wait beyond the free time at pickup or delivery for reasons within your control, detention or layover charges will apply at the rate in our tariff. Free time is typically measured from the moment the driver is ready to begin loading or unloading at the scheduled appointment.
Prohibited Conduct
You may not use our services or website for any unlawful purpose or in any way that could damage, disable, overburden, or impair our operations. This includes misrepresenting the nature of your freight, submitting fraudulent claims, using false payment methods, and interfering with the secure operation of our systems.
We are not able to transport items that are illegal to possess or move under applicable law, and we reserve the right to refuse any shipment that appears to violate these requirements. Nothing in these terms obligates us to accept a shipment that our team determines to be unsafe or unlawful.
Intellectual Property
The content on this website, including text, graphics, logos, layout, and design, is the property of JHL TRANS INC or its licensors and is protected by copyright and other intellectual property laws. You may view and print content for your personal, noncommercial use only.
You may not copy, reproduce, distribute, republish, or create derivative works from any part of this website without our prior written permission, except as expressly permitted by these terms or by law.
Warranty Disclaimers
To the extent permitted by law, our website and services are provided on an as is and as available basis. We make no representations or warranties of any kind, whether express or implied, regarding the availability, accuracy, reliability, or suitability of the website or any content on it.
We do not warrant that the website will operate without interruption or error, or that it is free of viruses or other harmful components. You use the website and rely on its content at your own risk. Your statutory rights, where they cannot be excluded, remain unaffected.
Limitation of Liability
To the fullest extent permitted by law, JHL TRANS INC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or interruption of business, arising out of or relating to your use of this website or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for all claims arising from a shipment or from your use of the website will not exceed the amount you paid for the applicable shipment or, in the case of website use, one hundred dollars, whichever is applicable. Certain statutes provide limits on the liability of a carrier for loss of cargo, and those statutory limits shall apply to our carriage services.
Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the State of California and the federal laws of the United States, without regard to conflict of law principles. Where a shipment moves in interstate or foreign commerce, the applicable federal transportation statutes and regulations also apply.
Any legal action arising out of or relating to these terms or our services shall be brought in the courts located in the State of California, and both parties consent to the exclusive jurisdiction and venue of those courts, subject to any right of the parties under applicable law to resolve claims by arbitration.
Dispute Resolution
We prefer to resolve differences by dialogue. Before resorting to formal process, you agree to contact us in writing to describe the dispute, and we will make a good faith effort to resolve it promptly. Many issues are settled by a single conversation with our team.
If the dispute is not resolved through discussion, and where the law requires or permits, the parties agree to participate in good faith mediation before initiating arbitration or litigation. Where claims are covered by an arbitration agreement incorporated into a signed transport contract, that agreement shall govern the process for resolving such claims.
Electronic Communications
When you visit our website, book a shipment, or send us a message, you consent to receive electronic communications from us. These communications may include service notices, pickup confirmations, delivery updates, and responses to your inquiries. You agree that electronic communications satisfy any legal requirement that written communications be provided in writing.
Communications sent to direct@anyit.buzz are treated as received when they reach our mail system, and communications we send to the email or telephone number you provide are treated as received when transmitted. You are responsible for maintaining current contact details so that we can reach you about your shipment.
Force Majeure
Neither party will be liable for any failure or delay in performing its obligations under these terms if that failure or delay is caused by circumstances beyond its reasonable control. These circumstances include acts of nature, severe weather, natural disasters, pandemics, labor disputes, government actions, strikes, terrorism, war, power failures, and disruptions to roads or general transport infrastructure.
If such an event occurs, we will use reasonable efforts to notify you and to reschedule or rearrange the affected movement as conditions allow. A shipment may be held at a safe location until it can be moved or until you instruct us otherwise, and any additional storage or handling costs that arise will be reasonably documented.
Assignment
You may not assign, transfer or subcontract any of your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to an affiliated company or to a successor in connection with a merger, acquisition, reorganization, or sale of substantially all of our assets, without requiring your consent.
Upon any permitted assignment, the terms will bind and benefit the assignee and the parties as their interests may appear. Any attempted assignment in violation of this section will be void, and nothing in these terms creates any obligation to accept assignments that we reasonably determine to be impractical or unwise.
Third Party Beneficiaries
Except as expressly stated, these terms do not create any rights for the benefit of any third party. You may not rely on these terms to make any claim against a third party, and no third party may enforce these terms against us.
Shippers, consignees and receivers named on a bill of lading are entitled to the benefits and subject to the obligations set out in that bill of lading and the applicable tariff, to the extent provided by law. Nothing in these terms limits the rights of freight claimants to the extent conferred by statute.
Entire Agreement
These terms, together with any bill of lading, rate confirmation, invoice and other written document we exchange for a specific shipment, constitute the entire agreement between you and JHL TRANS INC regarding the subject matter and supersede all prior agreements, understandings and representations, whether written or oral.
If there is a conflict between these terms and a specific written agreement for a shipment, the specific written agreement will control for that shipment, except where mandatory law applies. Our acceptance of your instructions does not waive any of these terms unless we expressly agree otherwise in writing.
Changes to These Terms
We may revise these terms at any time by updating this page. Changes take effect when they are posted on the website, unless a different effective date is stated. We will make reasonable efforts to highlight material changes.
Your continued use of the website or our services after changes are posted constitutes acceptance of the revised terms. Where a change affects a shipment already booked under a written agreement, the terms of that agreement will govern that shipment unless we agree otherwise in writing.
Severability
If any provision of these terms is held to be invalid, illegal, or unenforceable for any reason, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
The failure to enforce any provision of these terms does not constitute a waiver of that provision or of our right to enforce it later. A waiver of any provision in a particular instance will not operate as a general waiver.
